Insolvency

Insolvency refers to the legal state of a debtor's inability to pay debts or over-indebtedness, regularly initiating a judicial insolvency proceeding under the Insolvency Code (InsO). Those required to file for insolvency—whether personal or corporate insolvency—must submit an application to the competent insolvency court within three weeks of becoming insolvent. The court then opens the proceedings, appoints an insolvency administrator, and publishes the decision online as well as in the commercial or corporate register, allowing creditors to file their claims in a timely manner. The aim of insolvency law is either the orderly realization of the insolvency estate or reorganization through an insolvency plan to ensure the best possible satisfaction of creditors. For individuals, the procedure also offers the chance for discharge of residual debt after three years. For companies such as GmbH or AG, the register entry remains despite bankruptcy until the proceedings are concluded or dismissed for lack of assets and deletion is requested.
