Anhang

1. Allgemeine Angaben

Der Jahresabschluss der Triple S-GmbH i.I. wurde auf der Grundlage der Rechnungslegungsvorschriften des Handelsgesetzbuchs aufgestellt. Ergänzend zu diesen Vorschriften waren die Regelungen des GmbH-Gesetzes zu beachten.

Angaben, die wahlweise in der Bilanz, in der Gewinn- und Verlustrechnung oder im Anhang gemacht werden können, sind insgesamt im Anhang aufgeführt.

Nach den in §§ 267 und 267a HGB angegebenen Größenklassen ist die Gesellschaft eine Kleinstkapitalgesellschaft.

Die Gliederung des Jahresabschlusses entspricht den Vorschriften des HGB unter besonderer Beachtung der §§ 266 und 275 HGB.

Für die Gewinn- und Verlustrechnung findet das Gesamtkostenverfahren Anwendung.

Es wurde am 03.05.2017 das Insolvenzverfahren über das Vermögen der Gesellschaft eröffnet. Da keine positive Fortführungsprognose vorlag, wurden Liquidations- bzw. Veräußerungswerte in Ansatz gebracht. Diesen liegen grundsätzlich Gutachtenwerte von durch den Insolvenzverwalter beauftragten Sachverständigen zu Grunde.

2. Angaben zur Bilanzierung und Bewertung

Die Bewertung der sonstigen Vermögensgegenstände erfolgte zum Nennwert.

Die flüssigen Mittel wurden mit dem Nennwert angesetzt.

Die Rückstellungen wurden für alle ungewissen Verbindlichkeiten gebildet. Dabei wurden alle erkennbaren Risiken berücksichtigt.

Verbindlichkeiten wurden zum Erfüllungsbetrag angesetzt. Sofern die Tageswerte über den Erfüllungsbeträgen lagen, wurden die Verbindlichkeiten zum höheren Tageswert angesetzt.

3. Angaben und Erläuterungen zu einzelnen Posten der Bilanz und Gewinn- und Verlust rechnung

3.1 Sonstige Vermögensgegenstände
In den sonstigen Vermögensgegenständen sind solche mit einer Restlaufzeit von mehr als einem Jahr in Höhe von Euro 6.505,25 enthalten. Es handelt sich um Kautionen (Euro 6.505,25).

3.2 Betrag der Verbindlichkeiten nach Restlaufzeiten
Unter den Verbindlichkeiten sind solche mit einer Restlaufzeit von bis zu einem Jahr ausgewiesen. Darlehensverbindlichkeiten, insbesondere der Gesellschafter, die bislang unter den Verbindlichkeiten mit einer Restlaufzeit größer fünf Jahre ausgewiesen wurden, wurden in die Rückstellungen umgegliedert, da die Ansprüche vom Insolvenzverwalter bestritten wurden.

4. Sonstige Pflichtangaben

4.1 Namen der Geschäftsführer
Während des abgelaufenen Geschäftsjahrs wurden die Geschäfte des Unternehmens durch folgende Personen geführt:

- Herr Reiner Wittig, einzelvertretungsberechtigt

Für die Angabe der Organbezüge wurde von der Schutzvorschrift des § 286 Abs. 4 HGB Gebrauch gemacht.

Mit Datum vom 03.05.2017 wurde das Insolvenzverfahren über das Vermögen der Gesellschaft eröffnet. Zum Insolvenzverwalter wurde Rechtsanwalt Dr. Marc d´Avoine, Ratingen bestellt.

4.2 Angaben nach § 42 Abs. 3 GmbHG
Gegenüber den Gesellschaftern bestehen folgende Rechte und Pflichten:
